1. Generals

This is an abbreviated form of our terms and conditions for our sales and services. For all orders in our online shop by both final customers and businesses, the following terms and conditions apply. In any case the German text of these conditions shall prevail.
Consumer are all natural persons, who do business with us, but not on a professional basis. A business is a company or a natural person, who trades with goods for the sake pf profit. Our sales conditions shall prevail for all future activities unless we accept other conditions explicitly.

By placing the products in the cart of the online shop, we make a binding offer for a contract for these items. As long as the products are in the shopping cart there is no obligation for purchase, You can correct your entries at any time. However, when submitting, the order for the goods contained in the shopping cart is binding. The contract is concluded by clicking on the order button. Immediately after sending the order you will receive a confirmation by e-mail.

3. Language

This is an abbreviated form of our terms and conditions for our sales and services in English language. In any case the German text of these conditions shall prevail.
The sales condition are included in every confirmation mail and can also be found on our website. Old orders can no longer be re-called from our website due to data protection measures.
 

4. Terms of delivery

Delivery on invoice for public institutions and against prepayment (see below) for private persons.
All prices are in Euro. In addition to the prices for product, we add shipping costs. You can find out more about the amount of shipping costs on the website.
You can collect your goods also directly in our shop at Robe Academicus, Bahnhofstr. 18, 86911 Diessen Ammersee during our normal opening times: Mo-Fr 9am – 5pm

We do not delivery to Packstationen.
 
There are no liquidated damages for delivery delay. We exclude explicitly also liability for late delivery in case of force majeur.
 

5. Payment

Customer have several possibilities for payment

Advance payment
Customers find our bank details in the order confirmation mail. Except for universities delivery follows receipt of payment.

PayPal
In the order process you will be redirected to the website of the online payment provider PayPal. In order to pay the invoice amount via PayPal, you must be registered there or register beforehand, legitimize with your access data and confirm the payment order to us. After placing the order in the shop, we request PayPal to initiate the payment transaction. You'll get more information during the ordering process. The payment transaction will be carried out automatically by PayPal immediately thereafter.

PayPal Plus
As part of the payment service PayPal Plus, we offer you various payment methods as PayPal services. You will be redirected to the website of the online payment provider PayPal. There you can enter your payment details, confirm the use of your data by PayPal and the payment instructions to PayPal. You will receive further information during the ordering process. If you have chosen the payment method credit card, you do not have to be registered with PayPal in order to pay the invoice amount. The payment transaction will be processed by your credit card company at the request of PayPal and your card will be charged immediately upon confirmation of the money order and after your legitimacy as the legitimate cardholder.

Sofortüberweisung
After placing the order you will be redirected to the website of the online payment provider SOFORT Überweisung. In order to be able to pay the invoice amount via SOFORT Überweisung, you must have an online banking account with PIN / TAN procedure activated for participation in SOFORT Überweisung, have yourself legitimized and confirm the payment order to us. You'll get more information during the ordering process. The payment transaction will be carried out immediately after the purchase by SOFORT Überweisung and your account will be debited.

Amazon Payments
After clicking on the button "Pay with Amazon" you will be redirected to the website of the online provider Amazon before completing the order process in our online shop. In order to be able to process the order process via Amazon and pay the invoice amount, you must be registered there or first register and legitimize with your access data. There you can choose the delivery address and payment method stored on Amazon, confirm the use of your data by Amazon and the payment order to us. You'll get more information during the ordering process. Afterwards you will be redirected to our online shop, where you can complete the order process. Immediately after the order, we request Amazon to initiate the payment transaction. The payment transaction will be performed automatically by Amazon.

Cash
Of course, if you visit our shop, there is also the possibility that customer pay in cash, when picking up their goods personally.
 

6. Transfer of Ownership

Until full payment, goods remain our ownership.
For contracts with companies, we reserve the ownership of the goods until the complete settlement of all claims from an ongoing business relationship. You may resell the reserved goods in ordinary business; all claims resulting from this resale shall be assigned to us in advance - irrespective of any combination or mixing of the reserved goods with a new item - in the amount of the invoice amount, and we accept this assignment. You remain entitled to collect the claims, but we may also collect claims yourself, as far as you do not meet your payment obligations.
 

7. Damages during transport

If goods show obvious damages from transport, please direct your complaint directly to dispatching firm. Please inform us also immediately. Failure to inform us has no consequences for your statutory claims and their enforcement, in particular your warranty rights. However, they help us assert our own claims against the carrier or transport insurance.
 

8. Guarantee 

Unless otherwise expressly agreed otherwise, the statutory warranty rights apply. For consumers, the limitation period for claims for defects in used goods is one year from delivery of the goods.
For business partners, the limitation period for warranty claims is one year from the transfer of risk; the statutory limitation periods for the recourse claim under § 478 BGB remain unaffected.
With regard to business partners, the contract is based on product descriptions, which are provided by us and that were mentioned in the contract. We accept no liability for public statements made by anybody else or other advertising statements.
If the delivered goods are faulty, we initially provide to business partners at our discretion warranty by rectification of the defect (repair) or by delivery of a defect-free item (replacement).
The above limitations and shortened terms do not apply to claims for damages caused by us, our legal representatives or vicarious agents:
in violation of life, body or health
in case of intentional or grossly negligent breach of duty as well as malice
in case of breach of essential contractual obligations, the fulfillment of which enables the proper execution of the contract in the first place and on the compliance of which the contractual partner may regularly rely (cardinal obligations)
as part of a guarantee promise, as far as agreed
as far as the scope of the Product Liability Act is opened.

9. Liability

We are always liable without limitation for claims due to damages caused by us, our legal representatives or vicarious agents in case of
 injury to life, body or health,
in case of intentional or grossly negligent breach of duty,
with guarantee promise, as far as agreed, or
as far as the scope of the Product Liability Act is opened.
In case of breach of essential contractual obligations, the fulfillment of which enables the proper execution of the contract and on which the contractual partner may regularly rely (cardinal obligations) by slight negligence on our part, our legal representatives or vicarious agents, the liability shall be the amount foreseeable at the time of conclusion of the contract Damage limited, which typically has to be expected. Incidentally, claims for damages are excluded.
 

10. Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the date on which you or a third party named by you, who is not the carrier, has taken possession of the goods.
You can return your purchased goods within a period of 2 weeks by simply sending back the goods. Please inform us (Robe Academicus, Bahnhofstr. 18, D-86911 Diessen a. A., Tel. +49 8807 9497397, Fax. +49 8807 0497399) about your intention of returning the goods in a clear statement such as letter, fax or email within the two week claims period.You can use the attached model withdrawal form.
 

Consequences of cancellation / returning the goods
In case of returning the goods we will refund all payments, which we have received from you. This does not include special delivery cost (i.e. non-standard delivery such as express cost). We use the same payment method as used by you for your initial payment, except if agreed otherwise. There are no additional cost or hidden fees. Return payment is made against reception of goods.

 

For refund, you have to return the goods to us within 2 weeks from the moment you have informed us about returning the goods. Return delivery cost have to be paid by yourself. If you have damaged the goods, we reserve the right for compensation. We will not ask for compensation if you have damaged the goods while examining them like you would do in a normal shop.
 
 

11. Dispute resolution

The European Commission provides an online dispute resolution platform, available at https://ec.europa.eu/consumers/odr/. Consumers can use this platform to resolve disputes. In order to settle disputes arising from a contractual relationship with us of to find out whether such a contractual relationship exists at all, we are obliged to participate in such any dispute settlement from consumer arbitration board (Verbraucherschlichtungsstelle). Responsible is the Allgemeine Verbraucherschlichtungsstelle des Zentrums für Schlichtung e.V., Straßburger Straße 8, 77694 Kehl am Rhein, www.verbraucher-schlichter.de. We will participate in a dispute resolution procedure at this institution.
 

12. Final Clause and Applicable Law

If you are a company, then German law will apply explicitly excluding UN purchasing rights. Moreover, in case of dispute, court of jurisdiction is Landsberg am Lech (Germany).
